Terms of Service
There are some simple ground rules you'll need to agree to before using Spring. Playing by these rules is a mandatory part of using our application, so if you have any questions about them, please drop us a line and we'll respond as soon as possible.
By using or signing up for Spring, you are agreeing to be bound by the following terms and conditions (the “Agreement”).
By marking the applicable "I have read and agree to the terms of service" checkbox, you hereby agree to the Agreement.
1. Spring Account
To become a user, you must complete a sign-up form and create an account by providing first name, last name, email address, and any other information indicated as required. We may reject any order form or application for an account for any reason, in our sole discretion. You acknowledge that we will use the email address provided by you as the primary method for communication. You are responsible for keeping your account password secure. We cannot and will not be liable for any loss or damage arising from any failure to maintain the security of the account and password.
Either party may terminate this Agreement at any time, with or without cause, effective immediately upon written or electronic notice. Upon termination of this Agreement, all rights granted to you hereunder will immediately cease, including but not limited to the right to access the Account, unless otherwise determined in our sole discretion.
3. Intellectual Property Rights
You agree not to provide us with any confidential or proprietary information. Each party acknowledges and agrees that the other party may freely use and otherwise commercially use any ideas, feedback or suggestions provided by it to the other party.
We are not financial advisors, accountants or lawyers. Any information provided on this website or via emails is not intended as investment or financial advice. It is based upon people’s personal experiences. Information we present is of a general nature and should be used as to start your connection with financial mentors, budgeting advisers or MoneyMates groups. You should seek professional investment or financial advice before making decisions about your financial situation.
Spring is an independent start-up funded by the Digital Government Partnership Innovation Fund and the Ministry of Social Development and supported by Creative HQ (a subsidiary of the Wellington NZ). We don’t share your information with these funders.
We are not selling anything and we get no payments or other consideration for recommending you take any decision, visit any website, or buy anything.
We collect personal information from you, including your name so we can personalise your experience, and your postal address and contact information so we can contact you, and send you rewards vouchers. We need to know if you’re over 16 and what your post code is so we can assess your eligibility for the service.
We also collect information about your interactions with us, and ask you a number of optional questions; these are for reporting purposes, so we can evaluate and improve our service.
Providing some information is optional; if you don’t complete these fields it won’t affect the qualityof the service you receive. However if you don’t provide us with a postal address we may not be able to send you rewards vouchers you earn.
If you don’t provide us with your email, name, post code, and whether you’re over 16, you cannottake part in the service.
We keep your information safe by storing it in encrypted files, and anonymising it for Spring reporting. Only authorised Spring IT staff have access to non-anonymised data. All other Spring staff can only access anonymised data. We do not share your information with any other agencies, except where it has been made anonymous.
Besides our staff, we share this information with financial mentors in order to connect users with advice. This information is only shared when requested by our users, and will not be shared without our users’ consent.
We keep your information for two years at which point we securely destroy it by engaging a data destruction service.
You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. 6. General Provisions
This Agreement sets forth the entire agreement and supersedes any and all prior agreements, written or oral, of the parties with respect to the subject matter hereof. We reserve the right to update and change the Agreement prospectively by posting updates and changes on our website, www.spring.kiwi. You are advised to please check the Agreement from time to time for any updates or changes that may impact you. If a significant change is made, we will provide reasonable notice by email and an opportunity to terminate this Agreement if you do not agree with the change.
The parties to this Agreement are independent contractors. Neither party is an agent, representative or related entity of the other party. Nothing in this Agreement is intended to create, nor will it be construed as creating, any exclusive arrangement between the parties to this Agreement. This Agreement does not restrict either party from entering into similar arrangements with others. Each party understands that the other party may now or in the future be involved in developing or providing competitive products or services. Neither party is a liability for any failure or delay caused by any circumstance or event beyond its reasonable control.
